Regulator Corrects Unfair Terms and Conditions Set by Delivery Apps

SEOUL, Aug. 19 (Korea Bizwire)An unfair provision in the terms and conditions set by delivery apps that exempts them from responsibility for any misdelivery has been corrected, South Korea’s antitrust regulator said Wednesday.

The Korea Fair Trade Commission (KFTC) announced that Baedal Minjok and Yogiyo, the country’s No. 1 and 2 delivery apps, have corrected certain provisions in their terms and conditions.

Previously, the terms and conditions exempted the apps from taking any responsibility for damages inflicted upon consumers due to problems during the order and delivery process including delivery delays and misdelivery of food.

In response, the KFTC corrected the terms and conditions to impose responsibility for both ‘ordering food’ and ‘delivery of the ordered food’ on the delivery platforms.

These are unexceptional liabilities on delivery apps based on the fact that they charge consumers not just for the food, but also for the delivery.

Baedal Minjok and Yogiyo will notify customers of the corrected terms and conditions, which will take effect next month.
