SEOUL, June 25 (Korea Bizwire) – The Supreme Court on Tuesday ordered the retrial of a former employee of a Samsung Electronics subcontractor who was acquitted by a lower court despite having been indicted for stealing the manufacturing method of the waterproof adhesive used in Samsung mobile phones.

The top court overturned the acquittal of the defendant, surnamed Jung, and sent the case back to the Daejeon District Court in the central city of Daejeon, ruling that he should be punished for leaking trade secrets.

Jung is accused of filming the waterproof adhesive manufacturing method with his cell phone while working for the Samsung supplier from 2015 to 2016. He then moved to other companies, where he made similar products using the same technology he stole. He received a suspended prison sentence from a district court but Daejeon’s appellate court overturned his conviction.

The Supreme Court said the technology in question is a trade secret developed by the defendant’s former employer through significant investments.
